Aim

The aim of this unit is to help learners understand how to handle information and the legislation that supports this.

Unit Learning Outcomes

1

Understand the need for secure handling of information in social care settings.

Legislation related to handling information includes:

  • Data Protection Act 2018 (GDPR)
  • The Care Act 2014 – this is about the importance of sharing information at an early stage to ensure people are safe
  • The Health and Social Care (Safety and Quality) Act 2015

Learners need to be able to identify that they are responsible for protecting personal data and that they must respect confidentiality.

Reasons for having secure systems may include:

  • legal requirement
  • information is confidential
  • information may be used inappropriately if accessed by unauthorised people

Learners should describe a situation where they have information that would suggest an individual is at risk of harm or is likely to pose a risk of harm to someone else. e.g. Suspected abuse of a service user.

Assessment Criteria

  • 1.1

    Identify the legislation that relates to the recording, storage and sharing of information in social care.

  • 1.2

    Explain why it is important to have secure systems for recording and storing information in a social care setting.

  • 1.3

    Describe a situation where you must break confidentiality.

Know how to access support for handling information in social care settings.

Ways to access guidance, information and advice about handling information may include:

  • discussion with line manager
  • individuals can access their care information by completing an access to personal information request form or this request can be made verbally or in writing to a Data Protection Officer or manager
  • individuals can access their medical records by completing a Subject Access Request

By law all children and adults have the right to access their health and social care service records

Actions may include:

  • discussion with line manager
  • discussion with individual concerned
  • seek guidance from other key workers e.g. medical staff, police

Assessment Criteria

  • 2.1

    Describe how to access guidance, information and advice about handling information.

  • 2.2

    Outline what actions to take when there are concerns over the recording, storing or sharing of information.
